Terms of sale

Terms for using Clipio and buying credits.

Scope

Clipio is an online service operated by Clipio, [Adresse à compléter — rue, NPA localité, Suisse], that turns text descriptions into short videos using artificial intelligence. The offer is aimed at individuals and businesses in Switzerland, the European Union and the European Economic Area. These terms apply to every use of the service and every credit purchase. By creating an account, you accept them.

Account

You must be at least 18 years old. An account is personal; you are responsible for access to your email address and for activity on your account. If you act for a business, you confirm you are authorised to bind it.

Credits and prices

  • What a video costs in credits depends on its length and is shown before you start it. A version of a post in another language costs credits per language, shown before you order it. Free credits are offered at sign-up, once per person.
  • Credits are sold in packs at the final prices shown in Swiss francs (CHF), including any VAT due. Currency conversion fees charged by your bank are yours to bear.
  • Payment goes through Payrexx (TWINT or card). Credits are added as soon as Payrexx confirms the payment.
  • No subscription: no recurring payments.
  • Credits do not expire. They are personal, non-transferable and cannot be exchanged for money.

Ordering

An order works as follows:

  • You choose a pack on the Credits page.
  • You are taken to Payrexx’s secure payment page, which shows the pack, the total price and the payment methods. Until you confirm the payment, you can go back or cancel to correct your choice.
  • The contract is concluded when you confirm the payment and Payrexx confirms it.
  • You receive a confirmation by email and the credits appear in your account.

The contract can be concluded in French, German, Italian or English. These terms remain available and can be saved from this page; we keep your order data and share it with you on request.

Refunds

  • If a generation or a version in another language fails or is rejected by moderation, its credits are returned automatically.
  • A successful generation is not refundable, even if the result is not exactly what you expected: AI results vary from one generation to the next.
  • For each successful video you can start one free new attempt with the same brief and settings, within 7 days of its creation. A free attempt cannot itself be retried for free; at most 3 free attempts per 24 hours.
  • Subject to the right of withdrawal described below, purchased credits are not refundable.
  • If you are charged twice or we make a technical error, email hello@clipio.ch and we will put it right.

Right of withdrawal (EU and EEA consumers)

If you are a consumer living in the EU or the EEA, you can withdraw from a credit purchase without giving any reason within 14 days of the purchase.

To do so, send us a clear statement at hello@clipio.ch before the period ends, for example: “I withdraw from the contract for the purchase of the credit pack [pack name] ordered on [date]. Account email: [address].”

We refund you no later than 14 days after receiving your statement, using the same payment method and free of charge. If you expressly asked for the service to start during the withdrawal period, we deduct the value of the credits already used.

If you have used all the credits in the pack after expressly asking for the service to start and acknowledging that you thereby lose your right, withdrawal is no longer possible. Swiss law provides no statutory right of withdrawal for online purchases.

Acceptable use

You agree not to use the service to:

  • create illegal, violent, hateful or discriminatory content;
  • create sexual content, or content involving minors in any way;
  • depict the face, voice or likeness of an identifiable real person without their documented consent, impersonate someone or create deceptive deepfakes;
  • infringe third-party rights (trademarks, copyright, personality rights, privacy);
  • mislead the public, including through deceptive advertising, fraud or disinformation about health, safety or elections;
  • carry out facial recognition, biometric identification or surveillance of people;
  • bypass safety filters, or remove, alter or obscure watermarks and metadata that mark videos as AI-generated;
  • act from a country under Swiss, EU or US embargo, or on behalf of a person on a sanctions list.

Descriptions and photos may be filtered automatically. In case of abuse, we may remove content, suspend or close an account, and we tell you why. We may report clearly illegal content to the competent authorities, in particular content involving minors.

Reporting content

Anyone can report content they consider illegal by emailing hello@clipio.ch with:

  • the exact location of the content (link or video identifier);
  • the reasons why it is illegal;
  • your name and email address (optional for child sexual abuse content);
  • a statement confirming that your report is accurate and made in good faith.

We acknowledge receipt, review the report diligently and inform the reporter and the user concerned of our decision, with the reasons and the available remedies. This address is also our single point of contact for authorities and users under the EU Digital Services Act (arts. 11 and 12), in French, German, Italian or English.

AI-generated content

Videos are generated automatically by artificial intelligence models accessed through Higgsfield, for example Kuaishou’s Kling or ByteDance’s Seedance. Results can be inaccurate, unexpected or resemble existing content.

The ready-to-post version uses a synthetic voice (Microsoft Azure) that does not imitate any real person, and the script you approved. You are responsible for that script and the contact details shown; the suggested script is AI-generated and must be proofread.

Check every video before publishing it. Label it as AI-generated where the law or the platform requires it (for example the EU AI Act or the “AI-generated” label on TikTok, Instagram or YouTube), and do not present it as real footage in a way that misleads viewers.

In the app, every video is marked “AI-generated”, and the downloaded file name says so too.

Rights to the videos

Subject to third-party rights and our model provider’s terms, you may use your videos for personal and commercial purposes. We claim no rights to your descriptions, photos or videos; you only allow us to process and store them to provide the service.

By uploading a photo, you confirm that you hold the necessary rights to it and that the recognisable people in it have consented. You allow us to pass it to our generation provider and to keep it for at most 30 days to create and regenerate the video.

Depending on the applicable law, a video generated entirely by AI may not be protected by copyright.

Business customers and third-party data

If you use the service for a business and your descriptions or photos contain personal data about other people, we process that data as a processor on your behalf (art. 9 FADP, art. 28 GDPR): only to generate and store your videos, with the processors and security measures described in the privacy policy. You are responsible for having a legal basis to share that data with us. On request, we sign a separate data processing agreement.

Availability

We do our best to keep the service available but cannot guarantee it at all times. Features and the AI models used may change. If we permanently shut the service down, we will tell you at least 30 days in advance and refund purchased credits you have not used.

Liability

To the extent permitted by law, we exclude liability for slight negligence and for indirect damage such as lost profit. Liability for intent and gross negligence remains (art. 100 CO), as do mandatory consumer rights. You are responsible for how you use the videos.

Our AI model providers make their models available as they are and accept no liability towards you, to the extent permitted by law. You indemnify us and our providers against third-party claims arising from your descriptions or from using the videos in breach of these terms.

Ending the contract

You can ask us to delete your account at any time at hello@clipio.ch; any remaining credits are then lost, subject to the right of withdrawal. We may close an account that breaches these terms.

Changes

We may change these terms. The current version is published on this page; each purchase is governed by the version in force at the time of purchase.

Governing law and jurisdiction

These terms are governed by Swiss law, excluding the Vienna Convention on the International Sale of Goods. Consumers living in the EU or the EEA keep the protection of the mandatory provisions of the law of their country of residence. The place of jurisdiction is the registered office of Clipio, subject to mandatory jurisdictions, notably the consumer’s place of residence.
